Upon registration with the Service (either as a consumer or partner), a user profile is developed to further customize the user’s experience.

In addition, tracking information is collected as you navigate through our website (the “Website”) or use the Service, including, but not limited to geographic areas. If you are ordering a auto care via the Service, the driver’s mobile phone will record your GPS coordinates. Most GPS enabled mobile devices can define one’s location to within 50 feet. We collect this information in order to calculate your fare and do not use it for any other purpose.
We also collect device type and unique identifier when you use our mobile application, we use this information for the sole purpose of providing you with the most up to date application and features. You may also choose to upload photos while using the site or application, if you wish to do so this may be viewable by the car auto care service providers so that they are able to verify your vehicle. You may remove or update photos at anytime by logging into your account. If you use our services through your mobile device, we will track your geo-location information so that you are able to view the car auto care service providers in your area that are close to your location, set your auto care location, and our servicers are able to find the location in which you wish to have the vehicle auto care. We will not share this information with third parties for any purpose and will only use this information for the sole purpose of fulfilling your request. You may at any time no longer allow our application to use your location by turning this off at the device level.
To help us serve your needs better, we use “cookies” to store and sometimes track user information. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Cookies can be disabled or controlled by setting a preference within your web browser.
All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the Customers are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.
Our primary goal in collecting information is to provide you with an enhanced experience when using the Service. We use this information to closely monitor which features of the Service are used most, to allow you to view your auto care history, store your credit card information with our PCI certified payment partner, view any promotions we may currently be running, rate trips, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources, we use the mobile information collected so that we are able to serve you the correct app version depending on your device type, for troubleshooting and in some cases marketing purposes. We use the credit card information you provide us to bill you for services.
The Company uses your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer the Website. Your IP address is used to help identify you, and to gather broad demographic data. Your IP address contains no personal information about you.
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.
Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
Based upon the personally identifiable information you provide us, we may send you a welcoming email. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We may communicate with you by email or via telephone, SMS or WhatsApp on your mobile number, as per your convenience.
These Terms and the rest of the Agreement govern the access or use by you, of the Platform and the Services. Your access to and use of the Platform and any Service constitutes your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform or the Services. By accessing and using the Platform and any Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as amended from time to time. If you do not agree with these Terms, now or at any time, you must stop using or accessing the Platform and/or any Services immediately. If you are using the Platform on behalf of a third party including a business entity, you warrant that you are authorized and have the authority to bind that third party to these Terms.
The following terms are used throughout the Agreement and have the following specific meanings (unless a different definition is given in any specific document).
Account means a user account on the Platform in your name or an order placed with Mysyara under your name.
App means the mobile application that is provided by Mysyara, and which connects Clients with drivers and provides car services.
Charges mean charges to you in connection with the Services you receive from Third-Party companies arranged via the Platform.
Client means a person who contacts, engages, and/or aims to contact or engage a service through use of the Mysyara Services.
X`Content means any content submitted, generated, featured, displayed through the Platform (including any text, correspondence, photographs, graphics, software, applications, video recordings, audio recordings, sounds, designs, features, and other materials that are available on the Platform). Content includes, without limitation, User Content that may be submitted by a User.
Dispute has the meaning given to it in clause 2.2
Driver Services means driver services provided by companies like Mysyara, as outlined on the Platform.
Incident means any act, omission, or event in connection with the Driver Services or the Services, including any late arrival or alleged misconduct by a Driver or accident involving Your Car.
Losses mean any claims, demands, assessments, charges, losses, liabilities, costs and expenses (including attorneys’ fees, penalties, interest or loss of profits)).
Platform means any online tool provided, processed and/or maintained by us (including our App, whatsapp, website, all subpages and subdomains, all Content, Services, and products available at or through the Platform located at https://www.mysyara.com/or any other related domain offering access to, or facilitating the provision of, the Services).
Services mean our online and/or offline services for the provision and use of the technology that we have developed for collaboration, communication, and payment between Third-Party Driver Companies and you, including without limitation, access to our App, communication tools, and payment services which enable you to arrange, schedule and pay for Services with Third–Party Driver Companies.
Terms mean these terms and conditions.
Third-Party Content means any content that belongs to or originates from parties other than the User or Mysyara;
Third–Party Companies means independent companies which provide the Services arranged through the Platform.
User Content means any content, written or otherwise, created, submitted, generated, featured and/or displayed through the Platform (including any text, correspondence, audio and/or visual content, feedback related to the Services, initiation of support requests and submission of entries for competitions and promotions and photographs) by you or other Users while using the Platform.
Users mean the person, company, or organization that has visited or is using the Platform and/or any Service.
Vehicle Information means the information provided by a User when registering any vehicle in connection with their Account/ making an order, including the make, model, license plate and insurance status.
We, our, us, Mysyara means Mysyara Auto Care LLC, a company established in Dubai Media City with license number 838075 whose registered address is at Dubai Silicon Oasis – Dubai.
You, your means a User.
Your Car has the meaning given to it in clause 2.1.
2. User Requirements and Conduct
2.1. You are only allowed to make use of our Services in relation to a vehicle where (i) you are the owner the vehicle or (ii) the owner of that vehicle has consented that you use the Services in relation to it (such vehicle being referred to as “Your Car”).
2.2. YOU UNDERTAKE:
2.2.1. TO ONLY USE THE SERVICES IF YOUR CAR IS INSURED WITH VALID MOTOR VEHICLE INSURANCE THAT ALLOWS ANYONE WITH A VALID UAE DRIVER’S LICENSE TO DRIVE THE VEHICLE; AND
2.2.2. NOT TO DO ANYTHING TO ENDANGER OR INVALIDATE THE INSURANCE COVER IN RESPECT OF YOUR CAR.
2.3. YOU ACKNOWLEDGE THAT:
2.3.1. ZOFEUR, EACH DRIVER AND EACH THIRD-PARTY DRIVER COMPANY CAN AND WILL RELY UPON YOUR UNDERTAKINGS AND ACKNOWLEDGEMENTS IN RELATION TO YOUR CAR AND ITS INSURANCE WITHOUT FURTHER ENQUIRY.
2.3.2. YOU ARE RESPONSIBLE FOR CLAIMING REIMBURSEMENT OF ANY AMOUNTS TO WHICH YOU ARE ENTITLED UNDER THE TERMS OF ANY INSURANCE POLICIES YOU HAVE CONCLUDED;
2.3.3. YOU WILL USE YOUR FULL COMPREHENSIVE MOTOR VEHICLE INSURANCE TO CLAIM FOR ANY LOSSES;
2.3.4. IF YOU DO NOT PROCURE AND MAINTAIN FULL COMPREHENSIVE INSURANCE, YOU ARE SOLELY RESPONSIBLE FOR ANY LOSSES IN CONNECTION WITH YOUR CAR AND ITS USE IN CONNECTION WITH THE DRIVER SERVICES.
2.4. YOU HEREBY INDEMNIFY MYSYARA IN RESPECT OF ANY LOSSES WHICH IT MAY SUFFER OR INCUR WHICH ARE DIRECTLY OR INDIRECTLY RELATED TO YOUR FAILURE TO OBTAIN AND MAINTAIN INSURANCE IN RESPECT OF YOUR CAR IN ACCORDANCE WITH THESE TERMS AND APPLICABLE LAW.
2.5. You may only use our Services in relation to Your Car:
2.5.1. if Your Car is in compliance with the laws and the regulations.
2.5.2. if Your Car has been regularly maintained and serviced according to the manufacturer’s recommendations and has all the required safety equipment.
2.5.3. all Your Car’s equipment is in good working order, including tires, brakes, headlights, other lights, steering, and seat belts.
2.6. You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, whether to any Third-Party Company, Driver or any other party. You will be solely responsible for the full functionality of your vehicle. If Your Car fails to function (electrical, mechanical or other) in any way while the Services are being availed of by you, you will be responsible for all storage fees, roadside assistance, alternate transportation and repair of any kind and neither Mysyara nor the Driver or Third-Party Company shall be responsible in any manner whatsoever.
2.7. We do not procure insurance for, nor are we responsible for, damage or loss of any personal belongings or intellectual property whilst providing the Services. These include tapes, records, discs, or other similar audio visual or data electronic devices, any speed measuring equipment within the vehicle or any other accessories of any kind. It is your responsibility to ensure that you remove any personal belongings from the car before and after each Driver Service arranged through Mysyara.
3. User warranties
3.1. By accessing or using the Platform and/or Driver Services, you represent and warrant that: (i) all Vehicle Information was correct and accurate when provided to Mysyara and that you will ensure that all Vehicle Information is updated throughout the term of the Agreement, (ii) you have the authority to validly enter into and/or be bound by the Agreement; (iii) your use of the Services will be solely for lawful purposes that are permitted by the Agreement; (iv) your use of the Services will comply with all UAE local and federal laws, rules, and regulations, and with all of Mysyara’s policies; as amended from time to time and (v) each Vehicle is owned by an individual person (rather than a corporate entity) and the owner has authorized you to use the Vehicle for the purposes of receiving pick up and drop Services OR where the Vehicle is owned by a corporate entity, the use of the Vehicle for the purpose of receiving pick and drop Services is not in breach of any agreement between the User, the owner and/or the relevant corporate entity.
4. Limitation of Liability
4.1. Mysyara shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage related to, in connection with, or otherwise resulting from any use of the Services, even if Mysyara has been advised of the possibility of such damages. Mysyara shall not be liable for any damage, liability, theft, or loss arising out of: (i) your use of or reliance on the Services or your inability to access or use the Services; or (ii) any transaction or relationship between you and any Third-Party Company, even if Mysyara has been advised of the possibility of such damages. Mysyara shall not be liable for delay or failure in performance of the Services, any Driver Service, or any part thereof.
4.2. The Services may be used by you to request a service from a Third-Party Company which may include a pick and drop service from Mysyara , but you agree that Mysyara has no responsibility or liability to you related to any pick and drop Services other than as expressly set forth in these terms.
4.3. YOU ARE RESPONSIBLE FOR CLAIMING REIMBURSEMENT OF THE COST OF ANY DAMAGES UNDER THE TERMS OF ANY INSURANCE POLICIES YOU HAVE CONCLUDED. YOU AGREE NOT TO HOLD MYSYARA LIABLE FOR ANY DAMAGE, LOSS, AND/OR INJURY TO YOUR VEHICLE, PERSONS, OR PROPERTY.
4.4. You agree not to hold any Third-Party Companies, Mysyara, nor any Driver provided by third part companies or Mysyara, liable for any damage, loss, and injury to Your Car, persons, or property where the relevant authorities decided that the Driver was not at fault.
4.5. YOU AGREE NOT TO HOLD ANY THIRD–PARTY COMPANY NOR MYSYARA NOR ANY DRIVERS PROVIDED BY ANY OF THEM, LIABLE FOR ANY DAMAGE, LOSS, AND/OR INJURY TO YOUR CAR, PERSONS, OR PROPERTY EXCEEDING THE LOWER OF (I) AMOUNT OF THE EXCESS PROVIDED FOR BY YOUR MOTOR VEHICLE INSURANCE AND (II) AED 1000 PER INCIDENT. You agree to safeguard valuable items in Your Car and not to hold Third-Party Driver Companies liable for theft by any Driver provided by them.
4.6. If an Incident occurs, the User should immediately notify Mysyara at firstname.lastname@example.org, providing as much detail as possible
4.7. The limitations and disclaimer in this clause 15 do not purport to limit liability or alter your rights as a consumer to the extent any such limitations or alterations cannot be excluded under applicable law.
5.1. You agree to indemnify and hold Mysyara and its officers, directors, employees and agents harmless from and against any and all Losses arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services or your violation of the Agreement; (ii) any injury, accident, physical or property damage, loss of profit, property or business reputation, or otherwise that may be caused by you as a result of use of any Service or services or goods obtained through your use of the Services; (iii) errors, mistakes, or inaccuracies of your User Content, and/or information available on or through the Platform, or (iv) your unauthorized access to or use of our servers and/or any and all personal information stored therein, and/or any interruption or cessation of transmission to or from our servers, and/or any bugs, viruses, trojan horses, or the like, which may be transmitted by you to or through the Platform, and/or (v) failure or delay in the execution of any transactions through the Platform and/or the Services or, (vi) dispute, conflict or disagreement between Users or a User and a Driver or Third–Party Company or Mysyara in connection with the use of the Services; (vii) failure to ensure that any Driver or Third Party Company is lawfully licensed, registered and/or conducting business (as applicable) in the UAE and maintains the required government approvals to perform the Services.
5.2. You release Mysyara from any and all damages (actual and consequential) and Losses of every kind and nature, arising in connection with any dispute between you and a Driver and/or a Driver or Third-Party Company or Mysyara.
5.3. The Client agrees that Mysyrar and each Driver and/or Third-Party Company jointly and severally have the power to file and pursue lawsuits against the Client in respect of any claims, demands, actions, Losses, damages, fines, charges, liabilities, costs, and expenses which have been suffered or incurred by Mysyara and/or a Driver or Third-Party Driver Company, directly or indirectly, and that have been caused by the Client as a result of the Client’s use of any Service and/or Driver Service.
5.4. The Client further agrees that, in the event a Driver or Third–Party Company obtains a court judgment in its favour in respect of a lawsuit filed against Mysyara in relation to any Losses which have been caused by the Client, we shall be entitled to file a lawsuit against the Client and recover any amount that we had to pay to the relevant Driver or Third-Party Company as a result of the original lawsuit filed against us by the relevant Driver or Third-Party Driver Company.
5.5. You agree that in no event will Mysyara be liable, responsible or otherwise, to you or to third parties for any damages or Losses that may arise from (i) the failure, interruption or disruption of any service to maintain your access to the Platform or the Services, regardless of whether the service is provided by Mysyara or a third party or (ii) the quality, accuracy, timeliness, speed, reliability, performance of any Driver Service and/or the Platform, completeness or delays, breach, omissions, or interruptions in the delivery of any Driver Service (including without limitation any breach by a Driver or Third-Party Company of any obligation) or (iii) errors, mistakes, or inaccuracies of any Content and/or information available on or through the Platform, or (iv) any unauthorized access to or use of our servers and/or any and all personal information stored therein, and/or any interruption or cessation of transmission to or from our servers, and/or any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Platform by any third party, and/or (v) any failure or delay in the execution of any transactions through the Platform and/or the Services or, (vi) any dispute, conflict or disagreement between Users or Users and a Driver or Third-Party Company in connection with any Services, Driver Services or cancellation of any Confirmed Booking; and (vii) any refund, loss of profits, loss of business reputation (whether incurred directly or indirectly), any injury or accident or physical or property damage or health issues or otherwise that may occur to a Client as a result of use of any Driver Service.
6. Governing Law and Dispute Resolution
6.1. This Agreement and any access to or use of the Platform or the Services are governed by the laws of the United Arab Emirates as applied by the Courts of Dubai.
6.2. Mysyara and any User will each endeavour to amicably settle any dispute which may arise in connection with the Agreement or any Service (a “Dispute”). In the event that amicable settlement is not possible in connection with a Dispute, the Courts of Dubai shall have exclusive jurisdiction to settle the same.

You acknowledge that you have read, understood, and accepted to be bound by these Terms.
Targeted advertising (also known as Behavioral Advertising) uses information collected on an individual’s web browsing behavior such as the pages they have visited or the searches they have made. This information is then used to select which mysyara.com advertisement should be displayed to a particular individual on websites other than mysyara.com. For example, if you have shown a preference for nursing while visiting mysyara.com, you may be served an advertisement from mysyara.com for nursing related programs when you visit a site other than mysyara.com. The information collected is only linked to an anonymous cookie ID (alphanumeric number); it does not include any information that could be linked back to a particular person, such as their name, address or credit card number. The information used for targeted advertising either comes from mysyara.com or through third party website publishers.
We may display any review(s) submitted by you on our website, in-app or other places and platforms, along with your name. This information may be taken down by us after a request from you stating the same.

These third parties have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. We may also provide personal information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. The Company cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of the Company or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical or legally actionable activity.
If we are involved in a merger, acquisition, or sale of all or a portion of its https://www.mysyara.com, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
